NASEO has filed a motion with the Federal Energy Regulatory Commission (FERC) in the matter of the New England Ratepayers Association (NERA), Docket No. EL20-42-000, opposing NERA’s assertion that FERC has “exclusive federal jurisdiction over wholesale energy sales from generation sources located on the customer side of the retail meter” and that rates for the sales be priced consistent with PURPA and the Federal Power Act.
NASEO opposes NERA’s petition as it represents an intrusion on state authority. If granted, it would eliminate state jurisdiction over net metering programs and infringe on state policy directives, state legislation, and state public service commission authority over retail rates.
NASEO’s motion also supports the request for a time extension on comments from the National Association of Regulatory Utility Commissioners.
