Emory Law School’s Turner Environmental Law Clinic issued Mass-Based Clean Power Plan Compliance: State Law Impacts on Allowance Trading Programs in Eight Southeastern States, a report that analyzes state legal authorities that may affect state plan options for potential Clean Power Plan (CPP) implementation. States covered by the report include Alabama, Florida, Georgia, Kentucky, Mississippi, North Carolina, South Carolina, and Tennessee.
While not taking a position on the legality or merit of the CPP, NASEO supports the opportunity for states that choose to create compliance plans to have the flexibility to craft plans that best address their specific contexts and that can support other state energy, economic, and environmental objectives.
